Agreement to These Terms of Use
These Terms of Use govern the use of the Illuminated Heart website at https://www.illuminated-heart.com (the "Site") and any related content, features, resources, accounts, newsletters, subscriptions and online services made available through it (together, the "Services"). They are entered into between you and Illuminated Heart ("we", "us", "our"), a sole trader business operated by Kourosh Wallace, trading as Illuminated Heart, of 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London W1T 6EB, United Kingdom.
By accessing or using the Site, creating an account, subscribing to our newsletter or otherwise using the Services, you confirm that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, you must discontinue use of the Site and Services immediately. These Terms of Use should be read alongside the Illuminated Heart Terms and Conditions (which govern bookings and sessions), the Privacy Policy and the Illuminated Heart Policies. Where a booked session is concerned, the Terms and Conditions take precedence; these Terms of Use govern your use of the Site itself. Effective date: 11 August 2026.
1. Our Website and Services
The Site provides information about Illuminated Heart and its spiritual activation, healing and guidance services, together with booking facilities, written and audio-visual resources, and a paid monthly newsletter subscription that we intend to introduce. The Services are intended to support wellbeing and personal growth and are complementary in nature. Nothing on the Site is medical, psychological, psychiatric, legal or financial advice, and no content on the Site is a substitute for professional care or emergency treatment.
The Site is operated from the United Kingdom. We make no representation that the Site or Services are appropriate or available in any other location, and those who access the Site from elsewhere do so on their own initiative and are responsible for compliance with local law.
The Site is intended for users aged 18 or over. Anyone under 18 may only use the Site, book services or sub-scribe with the involvement and explicit written consent of a parent or legal guardian, as set out in the Terms and Conditions and the Illuminated Heart Policies.
We may add to, change or withdraw any part of the Site or Services at any time, as described in the Modifications and Interruptions section below.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and all of its content — including text, teachings, meditations, healing recordings, written guides, course and workshop materials, images, photographs, graphics, audio, video, page layouts, design and software (the "Content") — together with the Illuminated Heart name, logo and marks (the "Marks"), are owned or licensed by us and are protected by copyright, trade mark and other intellectual property laws in the United Kingdom and internationally. Third-party healing systems, modalities and their associated marks referred to on the Site remain the property of their respective owners and are used with permission or by lawful reference.
Your permitted use
You are granted a limited, non-exclusive, non-transferable, revocable licence to access the Site and to download or print Content you have lawfully obtained, solely for your own personal, non-commercial use.
No part of the Content or Marks may be copied, reproduced, recorded, republished, uploaded, posted, publicly displayed, translated, sold, licensed, redistributed, or used to teach, train or create derivative works — including for the training of artificial intelligence or machine-learning systems — without our prior written permission.
All rights not expressly granted are reserved. Any unauthorised use ends the licence granted above and may amount to an infringement of our rights.
If you wish to use any Content or Marks beyond this permission, please request written consent at kourosh@illuminated-heart.com.
Your contributions
If you submit a review, testimonial, comment, question, suggestion or other material to the Site or to us ("Contributions"), you confirm that it is your own original material, that you own or control all rights in it, and that it does not infringe anyone else's rights. You grant us a worldwide, royalty-free, perpetual licence to use, reproduce, adapt and display your Contributions in connection with operating and promoting the Site and Services. We may remove or edit any Contribution at any time and are not obliged to publish or retain it. We will not publish a named testimonial without your consent, and your session content remains confidential in line with the Confidentiality section of our Terms and Conditions and our Privacy Policy.
3. User Representations
By using the Site or Services, you represent and warrant that:
All information you provide, whether at registration, at booking or otherwise, is true, accurate, current and complete, and you will keep it up to date.
You are at least 18 years of age, or you are using the Site with the explicit written consent and involvement of a parent or legal guardian.
You have the legal capacity to agree to these Terms of Use and will comply with them.
You will not access the Site through automated or non-human means, such as a bot, script or scraper, and will not use the Site for any unlawful or unauthorised purpose.
You understand that the Services are complementary and spiritual in nature, that outcomes vary between individuals and cannot be guaranteed, and that you remain responsible for your own decisions and for seeking appropriate professional healthcare when required.
Your use of the Site does not breach any applicable law or regulation.
If any information you provide is untrue, inaccurate, out of date or incomplete, we may suspend or terminate your account and refuse any current or future use of the Site and Services.
4. User Registration
Some parts of the Site — including the paid monthly newsletter subscription we intend to introduce — require you to register and create a basic account. Registration will ask for basic personal details (such as your name and email address) and, where a paid subscription is taken, payment details, which are collected and processed as described in the Fees and Payment section and our Privacy Policy.
You agree to keep your password confidential and are responsible for all activity that takes place under your account.
You must not share, sell or transfer your account, or allow anyone else to use it.
Please notify us at kourosh@illuminated-heart.com as soon as possible if you believe your account has been accessed without your permission.
We reserve the right to remove, reclaim or change a username that we reasonably consider inappropriate, offensive or misleading.
You may close your account or unsubscribe from the newsletter at any time using the link in any newsletter email, through your account settings, or by contacting us at kourosh@illuminated-heart.com.
5. Fees and Payment
Certain parts of the Services are paid for, including sessions booked through the Site and any subscription products we introduce, such as the paid monthly newsletter. Prices are shown in pounds sterling (£) and include VAT where applicable, and the price of any subscription is displayed before you confirm your purchase. Payments are taken digitally by bank transfer or through the website booking and payment system; cash and cheque payments are not accepted. Payment in full is required at the time of booking unless a payment plan has been agreed in advance, and a booking is only confirmed once payment has been received.
Subscriptions and recurring payments
Subscriptions renew automatically each month at the price then in force until cancelled, and you authorise us and our payment provider to charge your stored payment method on each renewal date.
You may cancel a subscription at any time before the next renewal date; access continues to the end of the period already paid for, and part-months are not refunded unless required by law.
We may change subscription prices or features. Any change will be notified to you in advance and will apply from the next renewal, so that you can cancel first if you prefer.
If a payment fails, we may retry it and may suspend or end access to the subscription until payment is received.
You agree to keep your billing information current and to provide accurate payment details.
Card and bank details are handled by our third-party payment providers under their own terms and security standards; we do not store full payment card numbers ourselves. Refunds, rescheduling, cancellations and no-shows for booked sessions are governed by the Delays, Rescheduling, Cancellation & Refund Policy in our Terms and Conditions. We reserve the right to correct pricing errors, even after payment has been requested or received, and to refuse or cancel an order where an obvious error has occurred.
Your right to cancel – 14-day cooling-off period
If you are a consumer in the UK or EU, you normally have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel a purchase of digital content or services bought online within 14 days of the date of purchase, without giving a reason, and to receive a refund.
To cancel within the cooling-off period, simply tell us before the 14 days are up by emailing kou-rosh@illuminated-heart.com. No particular form of words is needed, but please include your name and the purchase concerned.
Refunds are made using the same payment method you used, within 14 days of us being notified.
If you ask us to begin supplying a subscription, download or other digital content during the 14-day period, you acknowledge that the right to cancel is lost once the digital content has been supplied, and that where a service has already started you may be charged a fair amount for what has been provided up to the point of cancellation.
This 14-day right applies to the initial purchase; it does not apply to each automatic renewal, which you can stop at any time before the renewal date as set out above.
For booked sessions, the cancellation and refund terms in our Terms and Conditions apply alongside, and do not reduce, your statutory rights.
6. Prohibited Activities
You may use the Site and Services only for their intended purpose. You must not use them for any commercial purpose except as expressly agreed with us in writing. In particular, you agree not to:
Copy, record, download, republish, resell, redistribute or share our Content, recordings, meditations, guides or course materials, or use them to teach or train others, without our prior written permission.
Systematically retrieve data from the Site to create a collection, database, compilation or directory, or to train artificial intelligence or machine-learning systems.
Use any scraper, robot, spider, data-mining or similar automated tool, or bypass any measure designed to prevent or restrict access to the Site.
Trick, defraud or mislead us or other users, including attempting to obtain account or payment information from others.
Upload or transmit viruses, malware, or any material that interferes with the operation, security or enjoyment of the Site.
Attempt to gain unauthorised access to the Site, other users' accounts, or the servers and networks on which the Site is hosted, or interfere with, disable or overburden them.
Impersonate another person, misrepresent your identity or affiliation, or use another user's account without permission.
Post or transmit material that is unlawful, defamatory, harassing, abusive, threatening, obscene, discriminatory, or that infringes anyone's intellectual property or privacy rights.
Behave aggressively, abusively or insultingly towards the practitioner or other users, or publish knowingly false claims intended to damage the reputation of Illuminated Heart or the practitioner, whether online or offline.
Record, photograph or livestream any session, workshop or call without the practitioner's prior written consent, or share any material that would breach another participant's confidentiality.
Use the Site or Services to advertise, solicit, send unsolicited communications, or promote a competing business.
Reverse engineer, decompile or disassemble any part of the software making up the Site, or remove any copyright or proprietary notice.
Use the Site or Services in any way that breaches applicable law or these Terms of Use.
7. Third-Party Websites and Content
The Site may contain links to third-party websites, applications, articles, videos, products, services or resources, and may make use of third-party tools such as booking systems, payment providers, video-call platforms and email or newsletter services. These are provided for convenience and are not investigated, monitored or checked by us for accuracy, suitability or completeness, and their inclusion does not imply endorsement.
If you leave the Site, you do so at your own risk and these Terms of Use no longer apply; you should read the terms and privacy policies of any third-party site you visit.
We are not responsible for the content, accuracy, availability, security or practices of any third-party site or service, or for any purchase or transaction you make with a third party.
Any dispute concerning a third-party product or service is between you and that third party.
8. Services Management
We reserve the right, but do not undertake an obligation, to monitor the Site and Services for breaches of these Terms of Use. Where we consider it reasonably necessary, we may take appropriate action, including reporting unlawful behaviour to the relevant authorities, refusing, restricting or disabling access to any Content or Contribution, removing material that is excessive in size or otherwise burdensome to our systems, and suspending, restricting or terminating accounts. We may also manage the Site in a way designed to protect our rights and property and to support its proper functioning. These rights are exercised reasonably and consistently with our right to refuse or discontinue services as set out in the Terms and Conditions.
9. Fair Usage Policy for Unlimited Plans
Where we offer a plan, membership or subscription described as "unlimited" — for example unlimited access to newsletter archives, resources, recordings or messaging support — that access is offered on a fair usage basis. It is intended for normal personal use by a single individual and is subject to the practitioner's reasonable availability.
"Unlimited" does not mean unrestricted or guaranteed immediate access, and it does not include unlimited one-to-one session time unless expressly stated.
Accounts and plans are personal to you and must not be shared with, resold to or used on behalf of other people or organisations.
Use that is excessive, automated, or significantly beyond what a typical individual user would reasonably require may be treated as unfair use, as may bulk downloading, mass forwarding or redistribution of materials.
Messaging or support included in a plan is answered within reasonable timeframes during normal working availability and is not a crisis or emergency service.
If we consider use to be unfair, we will normally contact you first to discuss it. Where it continues, we may apply reasonable limits, move you to a more suitable plan, or suspend or terminate the plan, giving a pro-rata refund of any unused prepaid period where it is fair to do so.
10. Privacy Notice
We care about privacy and data security. Please review the Illuminated Heart Privacy Policy at https://www.illuminated-heart.com/privacy-policy, which forms part of these Terms of Use and explains what personal data we collect, how it is used, stored and protected, how long it is kept, and the rights available to you under the UK GDPR and the Data Protection Act 2018. By using the Site or Services, you agree to be bound by that Privacy Policy.
The Site is hosted in the United Kingdom. If you access it from elsewhere, your data may be transferred to, stored and processed in the UK, and by using the Site you consent to that transfer, subject to appropriate safeguards.
Everything shared during enquiries, consultations and sessions is treated as private and confidential, as set out in the Confidentiality section of our Terms and Conditions.
Newsletter and marketing emails are sent only with your consent, and every message includes an unsubscribe link.
We do not knowingly collect data from children. Where a client is under 18, data is provided and managed through a parent or legal guardian.
Cookies
The Site uses cookies and similar technologies (such as pixels and local storage) to make it work properly, to keep you signed in, to remember your preferences, and — where you agree — to help us understand how the Site is used and to support our marketing. Full details are set out in our Cookie Policy at https://www.illuminated-heart.com/cookie-policy.
Strictly necessary cookies are needed for the Site to function, including for account log-in, booking and payment, and are set without consent.
Analytics, preference and marketing cookies are only set with your consent, given through the cookie banner when you first visit the Site.
You may withdraw or change your consent at any time through the cookie settings on the Site, and you can block or delete cookies through your browser settings, although some features may then not work as intended.
Some cookies are set by third parties, such as our booking, payment, video-call and newsletter providers, and are governed by their own policies.

11. Digital Millennium Copyright Act (DMCA) Notice and Policy
We respect the intellectual property rights of others. Although Illuminated Heart is based in the United Kingdom, we operate a notice-and-takedown procedure consistent with the United States Digital Millennium Copyright Act (DMCA) for the benefit of rights holders. If you believe that material available on the Site infringes your copyright, please send a written notice to our copyright contact using the details below.
Notifications of claimed infringement
Your notice must include all of the following:
A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
Identification of the material claimed to be infringing, with enough detail (such as a URL) for us to locate it.
Your name, postal address, telephone number and email address.
A statement that you have a good-faith belief that the use complained of is not authorised by the copyright owner, its agent or the law.
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.

Please be aware that under 17 U.S.C. § 512(f) a person who knowingly misrepresents that material is infringing may be liable for damages, and that we may forward your notice to the person who provided the material.
Counter notification and repeat infringers
If your material has been removed and you believe this was a mistake or misidentification, you may send a counter notification to the same contact, including your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good-faith belief it was removed in error, your contact details, and your consent to the jurisdiction of the appropriate court. Unless the original complainant files a court action, we may restore the material within ten to fourteen business days. We reserve the right to remove material, disable accounts and terminate access in appropriate circumstances, including for repeat infringers, and to take action under UK copyright law where applicable.
12. Term and Termination
These Terms of Use remain in force for as long as you use the Site or Services. We reserve the right, in our sole and reasonable discretion and without notice or liability, to deny access to the Site and Services to any person for any lawful reason, including breach of any warranty, representation or obligation in these Terms of Use or in our Terms and Conditions, and to terminate or suspend your account, delete any Contributions you have posted, and refuse further use of the Services. This mirrors, and is in addition to, our right to refuse or terminate services set out in the Terms and Conditions.
You may end this agreement at any time by closing your account, cancelling your subscription and ceasing to use the Site.
If your account is terminated for any reason, you must not register a new account under your own name, a false name or the name of a third party.
Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, indemnification, user data and governing law — continue to apply.
Termination does not affect any refund entitlement you already have under our Terms and Conditions or your statutory rights.
13. Modifications and Interruptions
We may change, update or remove content on the Site at any time, and we may modify or discontinue all or part of the Services without notice. We are not obliged to update any information on the Site. We cannot guarantee that the Site will be available at all times: we may experience hardware, software, maintenance or other issues, or may need to carry out updates, which can result in interruptions, delays or errors. Nothing in these Terms of Use obliges us to maintain, support or correct the Site, and we are not liable for any loss or inconvenience caused by downtime or discontinuance, save as set out in the Limitations of Liability section. Where a subscription is materially affected for a prolonged period, we will offer a fair adjustment or refund.
We may also revise these Terms of Use from time to time. The version in force is the one published on the Site at the time you use it, and material changes will be notified to registered users by email or by a notice on the Site before they take effect. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms of Use.
14. Governing Law
These Terms of Use, and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer resident in another country, you keep the benefit of any mandatory protections given to you by the law of that country.
15. Dispute Resolution
Informal resolution first
Most disagreements arise from innocent misunderstandings. If you are unsure, unhappy or unsatisfied with any part of the Site or Services, please contact us directly at kourosh@illuminated-heart.com in the first instance, rather than posting a public complaint or review, so that the matter can be discussed and resolved. We aim to acknowledge your concern within 24 to 48 hours and to resolve it within thirty days of receiving it.
If a dispute cannot be resolved informally
Both parties agree to consider mediation through an independent mediator or an approved alternative dispute resolution (ADR) provider before starting court proceedings. Mediation is voluntary and neither party is obliged to accept a proposed settlement.
Each party bears its own costs of any informal or mediated process, and the mediator's fees are shared equally unless otherwise agreed.
If a dispute is not resolved, it will be dealt with by the courts of England and Wales in accordance with the Governing Law section above.
Nothing in this section prevents either party from seeking urgent injunctive relief, from bringing a small claim, or from exercising any statutory right; your legal rights as a consumer are not affected.
Any claim should be brought individually and not as part of a class, collective or representative action, to the extent permitted by law.
16. Corrections
There may be information on the Site that contains typographical errors, inaccuracies or omissions, including in descriptions of services, session lengths, pricing, availability and other details. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information on the Site at any time, without prior notice. Where a booking or subscription has been made on the basis of an obvious error, we will contact you to confirm whether you wish to proceed at the corrected price or receive a full refund.
17. Disclaimer
The Site and its Content are provided on an "as is" and "as available" basis, and your use of them is at your own risk. To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly set out in these Terms of Use, including any implied warranties of accuracy, merchantability, fitness for a particular purpose or non-infringement.
Spiritual activation, healing and guidance are complementary wellbeing practices. They are not a substitute for medical, psychological, psychiatric, legal or financial diagnosis, advice or treatment, or for emergency care, and nothing on the Site should be relied upon as such. Please continue to follow the advice of your healthcare professionals and never stop or change prescribed medication without consulting your prescriber.
Results vary between individuals and no specific outcome, result, timescale or benefit is promised or guara-teed. Any testimonial or example shared on the Site reflects one person's experience only and is not a prediction of yours.
Any intuitive guidance, channelling or energy reading is offered as spiritual guidance only. It is not a medical diagnosis, financial advice or a pre-determined prediction, and all decisions remain your own, made through your own free will and judgement.
The Site is not suitable as a replacement for crisis support or emergency mental health care. In an emergency call 999; for urgent advice that is not an emergency call NHS 111 and select the mental health option; Samaritans can be reached free of charge, at any time, on 116 123.
We accept no responsibility for errors or omissions in the Content, for unauthorised access to our servers or your personal information, for interruption of transmission, or for viruses or harmful code transmitted by a third party.
We do not warrant, endorse or assume responsibility for any product, service or information advertised or of-fered by a third party through the Site or any linked website.
18. Limitations of Liability
Nothing in these Terms of Use limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded, and nothing affects your statutory rights as a consumer. Subject to that, and to the fullest extent permitted by law:
We are not liable to you for any indirect, consequential, incidental, special or exemplary loss, or for loss of profit, revenue, data, goodwill or anticipated savings, arising out of or connected with your use of the Site or Services.
We are not liable for any decision you take, or do not take, as a result of anything on the Site or received in a session.
Our total liability to you in connection with the Site and Services is limited to the amount you have paid to us in the six months before the event giving rise to the claim, or, where the claim relates to a specific session, to the fees paid for that session.
We are not liable for failure or delay caused by events beyond our reasonable control, including illness, power or internet failure, platform outages, industrial action, extreme weather or acts of government.
19. Indemnification
You agree to defend, indemnify and hold harmless Illuminated Heart, its practitioner, and any subcontractors, agents or suppliers, against any loss, damage, liability, claim or demand, including reasonable legal fees, made by a third party and arising out of your use of the Site or Services, your breach of these Terms of Use, your breach of any representation or warranty given in them, your Contributions, your infringement of a third party's rights, or any harmful act towards another user. We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with that defence. We will use reasonable efforts to notify you of any such claim as soon as we become aware of it. This clause does not apply to the extent that the claim arises from our own breach or negligence.
20. User Data
We maintain certain data that you transmit to the Site — including account details, booking and subscription records, correspondence and session notes — for the purpose of managing the performance of the Services, as well as data relating to your use of the Site. Session notes and personal information are stored securely, are accessible only to the practitioner, and are kept only for as long as necessary, as described in our Privacy Policy.
Although we perform regular routine backups, you are solely responsible for keeping your own copies of any material you transmit to the Site or generate through the Services.
We have no liability to you for any loss or corruption of such data, and you waive any right of action against us arising from it, except where the loss results from our breach of data protection law or our own negligence.
You have rights of access, correction, erasure, restriction, portability and objection in relation to your personal data. To exercise them, contact us at kourosh@illuminated-heart.com; you also have the right to complain to the Information Commissioner's Office.
21. Electronic Communications, Transactions and Signatures
Visiting the Site, sending us emails and completing online forms are electronic communications. You consent to receive communications from us electronically — including consent forms, booking confirmations, joining details, receipts, newsletters and service notices — and you agree that all agreements, notices, disclosures and other communications provided electronically satisfy any legal requirement that they be in writing. You further agree that electronic signatures, ticked consent boxes, online orders and other electronic records are legally valid and binding, and you waive any requirement for an original non-electronic signature or record, to the extent permitted by law. This does not affect our obligation to provide information required by consumer law in a durable medium.
22. California Users and Residents
If you are a California resident, the following additional provisions apply. If a complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone on (800) 952-5210 or (916) 445-1254.
Under California Civil Code Section 1789.3, users are entitled to this notice of their rights regarding consumer complaints.
California residents under the age of 18 who are registered users may request removal of content they have publicly posted on the Site by contacting us at kourosh@illuminated-heart.com with a description of the content and confirmation that they are a California resident. Please note that removal does not guarantee complete or comprehensive removal of the content from all locations.
California residents may have additional rights under the California Consumer Privacy Act, including rights to know, delete, correct and opt out of the "sale" or "sharing" of personal information, and the right not to be discriminated against for exercising them. We do not sell personal information. Please see our Privacy Policy or contact us at kourosh@illuminated-heart.com to exercise these rights.
23. Other Important Information
Entire agreement. These Terms of Use, together with the Illuminated Heart Terms and Conditions, Privacy Policy, Cookie Policy and Policies, and any policies or operating rules posted on the Site, form the entire agreement between you and us regarding your use of the Site and Services.
Order of precedence. Where a conflict arises in relation to a booked session, the Terms and Conditions prevail; in relation to your use of the Site, accounts or subscriptions, these Terms of Use prevail.
No waiver. Our failure to exercise or enforce any right or provision does not operate as a waiver of that right or provision.
Severability. If any provision is found to be unlawful, void or unenforceable, that provision is severable and does not affect the validity and enforceability of the remaining provisions.
No partnership or agency. Nothing in these Terms of Use creates any joint venture, partnership, employment or agency relationship between you and us.
Assignment. We may assign or transfer our rights and obligations to another organisation; you may not transfer yours without our prior written consent.
